Terms & Conditions

These Terms & Conditions ("Terms") govern the use of services provided by Cybermate Solutions ("Company", "we", "us", or "our"), located in Sanhoula, Bhagalpur, Bihar, India. By purchasing, accessing, or using our services, you ("Client", "you", or "your") agree to be bound by these Terms.

1. Services Provided

Cybermate Solutions provides a range of IT and digital solutions, including but not limited to:

  • Cybersecurity services (VAPT, penetration testing, audits, security consulting)
  • Network and infrastructure security
  • Web and application development
  • IT support and maintenance
  • Cloud and server deployment solutions
  • Graphic design and UI/UX services
  • Digital marketing solutions
  • IT training and workshops

The exact scope of work, deliverables, and timelines for each project will be defined in a separate written proposal, quotation, or service agreement before the start of the engagement.

2. Payment & Billing

  • All prices are generally quoted in INR (Indian Rupees), unless otherwise specified.
  • An advance payment may be required to initiate work on a project.
  • Full payment must be completed before final delivery or deployment of the project, unless otherwise agreed in writing.
  • Delays or suspension of services may occur in case of late or incomplete payments.

3. Refund Policy

Our refund policy is as follows:

  • Refunds are provided only if Cybermate Solutions fails to deliver the service as agreed upon in writing.
  • No refunds will be issued for change of mind after work has commenced.
  • No refunds will be issued for project delays caused by the client, including but not limited to missing content, delayed approvals, or unavailability.
  • No refunds will be issued for completed work or already delivered modules.

If a refund is approved, it will be processed within 7–21 working days.

4. Ownership & Licensing

  • For software, website, or app development projects, Cybermate Solutions retains ownership of all source code, designs, and related intellectual property until full payment is received.
  • Upon receipt of full payment, the client receives a license or ownership as defined in the specific project agreement.
  • For cybersecurity reports, audit findings, and technical documentation, the client receives the right to use the deliverables for internal purposes, while methodologies, tools, and internal processes remain the intellectual property of Cybermate Solutions.

5. Confidentiality & Data Protection

  • We treat all client information, business data, system details, and any sensitive information shared with us as strictly confidential.
  • We may sign a Non-Disclosure Agreement (NDA) upon request, or include confidentiality clauses in our service contract.
  • Both parties agree not to disclose each other's confidential information to any third party without prior written consent, except where required by law.

6. Acceptable Use & Prohibited Activities

Clients agree not to use our services, deliverables, or platforms for any illegal or unethical activities, including but not limited to:

  • Unauthorized hacking, intrusion, or cyberattacks
  • Distribution of malware, ransomware, or harmful code
  • Fraud, impersonation, or phishing activities
  • Any action that violates the Information Technology Act 2000 (India) and its amendments or any other applicable law

Cybermate Solutions reserves the right to refuse, suspend, or terminate services if we suspect misuse or illegal activity.

7. Service Timelines & Dependencies

  • Project timelines will be mentioned in the proposal or agreement.
  • Delays in providing content, approvals, access details, or feedback from the client will extend the delivery schedule.
  • We are not responsible for delays or issues arising from third-party service providers like hosting, domain registrars, payment gateways, or APIs.

8. Limitation of Liability

  • Cybermate Solutions will take reasonable care and professional diligence while delivering services.
  • However, we are not liable for indirect, incidental, or consequential damages, including but not limited to loss of data, revenue, or business opportunities.
  • Our maximum liability, if established, shall be limited to the total amount paid by the client for the specific service or project in question.

9. Third-Party Services

Some services may involve integration with third-party platforms such as hosting providers, payment gateways, APIs, or SaaS tools. We do not control these third parties and are not responsible for:

  • Downtime, outages, or security issues on third-party platforms
  • Changes in pricing, policies, or features by third-party providers

10. Termination of Services

  • Either party may terminate a service agreement by providing written notice, subject to the terms defined in the specific agreement.
  • In case of client-side termination after work has started, payments already made are non-refundable (except where we fail to deliver as per agreement).
  • We may terminate services without refund in case of non-payment, misuse, policy violations, or illegal activity.

11. Changes to Terms

We may update these Terms & Conditions from time to time. The latest version will always be available on this page. Your continued use of our website or services after changes indicates your acceptance of the updated Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in or nearest to Bhagalpur, Bihar, India.
